Please read these terms carefully before engaging our deck construction services

1. Agreement to Terms

By engaging Midwest Deck Builders for deck construction services, you agree to be bound by these Terms and Conditions. These terms apply to all services provided by Midwest Deck Builders in the Minneapolis, St. Paul, and Twin Cities metropolitan area.

2. Services Provided

Midwest Deck Builders provides professional deck construction services including:

  • Custom deck design and consultation
  • Composite deck installation
  • Wood deck construction
  • Deck repair and maintenance
  • Permit assistance and code compliance
  • Material sourcing and installation

3. Service Areas

Our services are provided throughout the Twin Cities metropolitan area, including but not limited to Minneapolis, St. Paul, Minnetonka, Plymouth, Edina, Bloomington, Eden Prairie, and surrounding communities within a 30-mile radius of our Minnetonka location.

4. Estimates and Contracts

4.1 Estimates: All estimates are provided free of charge and are valid for 30 days unless otherwise specified. Estimates are based on site conditions at the time of inspection and may be subject to change if conditions differ during construction.

4.2 Contracts: All work begins only after a signed contract and required deposit. Changes to the scope of work require written approval and may result in additional charges.

4.3 Permits: While we assist with permit applications, approval is subject to local building departments. Permit delays do not constitute breach of contract on our part.

5. Payment Terms

5.1 Payment Schedule: Typical payment schedule is:

  • 25% deposit upon contract signing
  • 50% at project start/material delivery
  • 25% upon project completion

5.2 Payment Methods: We accept cash, check, and credit cards. A 3% processing fee applies to credit card payments.

5.3 Late Payments: Overdue payments may be subject to a 1.5% monthly service charge and may result in work stoppage.

6. Materials and Workmanship

6.1 Materials: We use only high-quality materials from reputable manufacturers. Material selections are subject to availability, and suitable substitutions may be made if specified materials become unavailable.

6.2 Workmanship: All work is performed by licensed, insured professionals in accordance with Minnesota building codes and industry best practices.

6.3 Site Conditions: Customer is responsible for ensuring clear access to work areas and marking any underground utilities or obstacles.

7. Warranties

7.1 Workmanship Warranty: We provide a 2-year warranty on workmanship and installation from project completion date.

7.2 Structural Warranty: Structural elements are warranted for 10 years against defects in workmanship.

7.3 Material Warranties: Materials carry manufacturer warranties which we will honor and assist with claims.

7.4 Warranty Exclusions: Warranties do not cover damage from acts of God, misuse, normal wear, lack of maintenance, or modifications by others.

8. Weather and Delays

8.1 Weather Delays: Construction schedules may be affected by Minnesota weather conditions. Weather-related delays do not constitute breach of contract.

8.2 Force Majeure: We are not liable for delays caused by circumstances beyond our control, including but not limited to severe weather, material shortages, permit delays, or government actions.

9. Insurance and Liability

9.1 Insurance: Midwest Deck Builders maintains comprehensive general liability and workers' compensation insurance.

9.2 Property Protection: We take reasonable precautions to protect your property but are not responsible for damage to landscaping, irrigation systems, or other improvements not disclosed prior to work commencement.

9.3 Liability Limitation: Our liability is limited to the contract value of the work performed.

10. Customer Responsibilities

Customer agrees to:

  • Provide clear access to work areas
  • Mark all underground utilities and irrigation systems
  • Remove or protect valuable landscaping and personal property
  • Ensure pets are secured during work hours
  • Make timely payments per contract terms
  • Communicate any concerns promptly

11. Changes and Modifications

Any changes to the original scope of work must be approved in writing and may result in additional charges and time extensions. Verbal authorizations for changes are not binding.

12. Cancellation Policy

12.1 Customer Cancellation: Customers may cancel within 72 hours of contract signing with no penalty if no work has commenced. After work begins, customer is responsible for costs incurred.

12.2 Contractor Cancellation: We reserve the right to cancel contracts for non-payment, unsafe conditions, or violation of these terms.

13. Dispute Resolution

Any disputes will be resolved through binding arbitration in Hennepin County, Minnesota, under Minnesota state law. Customer and contractor agree to attempt good faith resolution before pursuing legal action.

14. Code Compliance

All work is performed to meet or exceed current Minnesota building codes. However, local building officials have final authority on code interpretation and may require modifications during construction.

15. Cleanup and Completion

We will remove construction debris and perform reasonable cleanup. Final cleanup of fine dust, landscaping restoration, and minor touch-ups are customer responsibilities unless specifically contracted.

16. Lien Rights

Minnesota law provides contractors with lien rights for unpaid services. Full payment releases these rights upon project completion.

17. Privacy and Communication

We respect customer privacy and maintain confidentiality of project details. We may request permission to photograph completed projects for marketing purposes.

18. Governing Law

These terms are governed by Minnesota state law and local ordinances where work is performed.

19. Severability

If any provision of these terms is found unenforceable, the remainder shall remain in full force and effect.

20. Entire Agreement

These terms, together with the signed contract, constitute the entire agreement between parties and supersede all prior negotiations and understandings.

22. Modifications to Terms

These terms may be updated periodically. Customers will be notified of significant changes. Continued use of our services after changes constitutes acceptance of updated terms.
